Unless exempted, loans or other extensions of credit between ERISA-governed retirement plans or IRAs and related persons may constitute prohibited transactions" under ERISA and the Internal Revenue Code, resulting in penalties, fiduciary liability exposure, and, in the case of an IRA, loss of tax-advantaged treatment.
